MORGAN HORSES Breeding Contract
This contract is for the 2009 breeding season.
Linda Sterling, as owner of the stallion Zeulners Silver Legacy AMHA #167795,
hereinafter called stallion owner or agent, agrees to breed:

The mare owner agrees to have the mare bred to Zeulners Silver Legacy under the
following terms and conditions:
1. The breeding fee is $750.00 and shall be paid by the Mare Owner to the
Stallion owner as follows:
a. $250.00 paid as a booking fee upon execution of this contract.
b. $500.00 paid upon arrival of the mare for breeding at Sterling Morgans or
before any shipment of transported semen.
2. The following expenses are for fresh cooled semen transport:
I. There is a $250 deposit required for the shipping containers. This will be
refunded if the container is returned and not damaged.
II. Federal Express will be the designated carrier unless other arrangements are
made.
III. Whenever possible, carrier charges will be directly billed to Mare Owner by
carrier.
IV. When direct billing is not possible, carrier charges will be paid by check
by Mare Owner.
V. Mare Owner must return containers by way of next day Federal Express. A
maximum of six days following the shipment of semen will be allowed for the
return of the container, after six days a late charge of $10.00 per day will be
charged, and when container is returned the late charge will be paid by check by
Mare Owner.
VI. Sterling Morgans are responsible for delivery to the carrier only and shall
not be held responsible for any delays or damages beyond delivery to the
carrier.
3. The following pertains to mares being brought to Sterling Morgans for
breeding:
I. Mare’s care is $7.00 per day or $10.00 per day for a mare and foal. A reduced
fee of $190 per month will be charged for mares who stay a month or more. Grass
or Alfalfa hay is available; grain is at owners expense. All mare care shall be
paid monthly and shall be paid in full prior to departure of mare.
II. Sterling Morgans shall have the right to obtain all veterinary and farrier
services they believe to be required. All such veterinary and farrier charges
shall be paid monthly and prior to departure. Every effort will be made to
notify the mare owner before any expenses are incurred.
III. For mares brought to Sterling Morgans from out of state, a current negative
coggins test,
Is required.
IV. Sterling Morgans shall exercise reasonable care for health and breeding of
mare (and foal), for which Mare Owners will assume full financial
responsibility.
V. Mare Owner agree to hold harmless and indemnify the Stallion Owner, and
Agent, their employees, or anyone associated with, for any injury, death, loss,
or damage . Insurance for mare (and foal, if any) shall be the sole
responsibility of the Mare Owner.
4. Upon arrival of the mare at Sterling Morgans, or before any semen is shipped,
the Mare Owner shall provide Sterling Morgans the results of a uterine culture
taken within 45 days prior to first shipment of semen and processed by a
recognized laboratory. The designated veterinarian must examine the mare within
45 days prior to arrival at Sterling Morgans or shipment of semen and certify in
writing that the mare is free of infection and in good condition.
5. Breeding fees paid are non-refundable. However, the Stallion Owner offers a
live foal guarantee to the Mare Owner. A live foal is defined as one, which is
able to stand and nurse. In the event that the mare does not produce a live foal
following the first breeding season, the Mare Owner may rebreed at no additional
breeding fee the following year. If ownership and fertility of stallion hasn't
changed in the following years, and the mare still hasn't settled in foal, mare
owner may continue to breed this mare to this stallion for 2 more years (for a
total of 3 years trying). The last 2 years a re-booking fee of $250/per year
will be required, as well as a yearly and current uterine biopsy report on the
mare being bred. Substitution of mare is permissible only with the approval of
the stallion owner. Should the above named mare prove to be barren, or abort, or
should the foal be unable to stand and nurse, the Mare Owner must notify the
stallion owner and provide a certificate signed by a licensed veterinarian so
stating within 72 hours of the foal’s death of such other determination.
6. Breeding to Zeulners Silver Legacy has a chance of 50%-50% chance of a silver
dapple foal. If the resulting foal is not a silver dapple, as proved by genetic
color testing by a certified laboratory, Sterling Morgans is offering a free
breeding to Zeulners Silver Legacy the following year, with only a reduced
booking fee of $100. Mare care or shipping fees do apply.
7. Appended hereto and made an integral part hereof is a Mare Information Form,
the completion and truth of which is an essential consideration of this
contract.
In summary, the breeding fee is $750, $250 due at booking with the signed
contract, and $500 due upon arrival at Sterling Morgans or before semen is
shipped. There are NO ADDITIONAL charges such as a separate booking fee or
collection fee. Live foal guarantee, and a free breeding is available is the
resulting foal is not silver dapple. See above paragraphs for details of the
summary.
